About this Webinar In its efforts to drive the adoption of collaborative contracting in Singapore, the Building and Construction Authority (“BCA”) announced on 29 April 2024 the launch of the NEC4 contract for construction and engineering projects in Singapore by way of a set of NEC4 Y (SG) clauses to align the NEC4 contract with Singapore’s laws.

Please join us for a deep dive into data centre risk considerations during the development stage. Chris Bickerstaff, Marsh Asia Construction leader, will discuss the risk universe from ground breaking until commercial operations, and explore some of the complexities of developer-operator-contractor relationships in regards to risk allocation and responsibilities. Chris will then share some industry best practices with regards to risk transfer solutions after these risks have been identified and allocated to the relevant parties.

This is Not Another Covid-19 Force Majeure Talk. Join us for a seminar where our speakers Kelvin and Joanna discuss the law behind commonly-seen excuses for not performing the contract. They will discuss clauses which allow the contractor to escape the consequences of not carrying out the contract, including the implications of extensions of time and force majeure clauses and frustration. They will delve into issues such as when is weather “exceptionally” adverse, when is government delay a ground for EOT and who is the “governmental authority”, when do illegal acts justify non-performance, and when does a disease become an “outbreak”— things and factors often encountered in construction projects which have the potential to significantly impact the progress of works.
