Since the Inaugural Annual Construction Law Updates seminar in January 2011, SCL (Singapore) has organised an annual update which has been well-received as a key landmark in each year's construction law-related training calendar.  SCL (Singapore) is pleased to present its must-attend annual overview of key legal issues affecting the construction law industry in Singapore this past year. 

Equity in the Market Place: Reviewing the Use of Unconscionability to Restrain Calls on Performance Bonds

Unconscionability as a distinct ground for restraining calls on performance bonds is part of Singapore law. While the Singapore judges have articulated the policy reasons for restraining performance bond on this ground, they have thus far not explained the doctrinal basis for the unconscionability exception. This point is important because it would impact on the issue of whether the unconscionability exception may be contractually excluded by the parties.

Practical Problems Arising from the Pacing of Delays on Constrcution Projects- 24 February 2016

There is unfortunately little literature, and a paucity of legal authority on this difficult subject. In December 2012, the Singapore Institute of Architects (SIA) published the SIA ARTICLES AND CONDITIONS OF CONTRACT for MINOR WORKS 2012 (MWC 2012).  The MWC 2012 was written to address the unique challenges of smaller projects, often involving lay Employers such as house owners, management corporations, companies carrying out renovations to their own premises, etc., new statutes and the use of electronic communication.
